Terms of Business

This agreement is to apply between Heaven Sent 4 U and the client.By accepting details and engaging an applicant by way of introduction through H.S.4.U both the client and H.S.4.U agree to observe the following terms of business. H.S.4.U acts as an agent in bringing you and your prospective employee together; we are NOT the employer of the appointed employee. All final arrangements and the contract of employment are made between you as the employer and the person you employ. H.S.4.U accepts no liability whatsoever for any loss, damage, claim or any other expense of any kind arising in relation to or from the employment relationship. We are a referral service only and will to the best of our ability and expertise match requirements as needed.

1. The agency will endeavour to interview the applicant, screen the applicant's references and to adhere to appropriate checks, when we have selected a potential employee our process includes: A working with children check for relevant offences from The NSW Commission for Children and Young People ,however the client make's the final decision whether or not to employ the referred applicant.

2. Each employee is engaged and paid directly by the client; the client is required to meet all obligations and comply with any legislation relating to industrial relations, workers compensation, taxation and superannuation,For more detailed information you may contact the ATO on 13 28 61 or at www.ato.gov.au. It is strongly recommended that the client ensure that they have suitable and adequate insurance cover.

3. For all permanent placements, clients will be invoiced and must pay the placement fee prior to commencement date or placements will not commence. Agencies fees are to be paid at least seven days in advance of placement. We offer a four-week free replacement guarantee for all permanent positions. If within this time the applicant leaves or becomes unsuitable we will endeavour to fill the position for you free of charge, however this service is only offered once and if aNanny is no longer needed or a suitable one cannot be found a refund of the placement fee will be made after an agency fee has been deducted of $22 per day for each day the employee has worked. If an applicant is engaged or re-engaged within 12 months of the termination of her/his services, the full agency fee will become due and payable. An agency fee is also payable if the applicant is engaged by a third party or referred from the applicant directly without the agency's knowledge. A fee is applicable for engaging any placement-applicant introduced to client/s by this agency.

4. Introductions are confidential, if client/s approach any of our introduced placement-applicants to work on a private basis they will be liable and invoiced for a booking fee.

5. Both parties acknowledge that the terms of this agreement are Confidential, this is a binding contract between the client and Heaven Sent 4 U.
